Deputies will consider a bill on confiscation of property for crimes against state security.

Introduced to the State Duma amendments in the Criminal and Criminal Procedure Codes on the confiscation of property for public calls for activities directed against the security of the state, for discrediting the army and a number of other articles.

The co-authors of the bill are Chairman of the State Duma Vyacheslav Volodin, leaders of factions, chairmen of committees, and many State Duma deputies.

The bill amends Article 104.1 of the Criminal Code of the Russian Federation (confiscation of property) and expands the list of crimes for which it can be applied. In particular, it is proposed to include crimes under Article 207.3 of the Criminal Code of the Russian Federation (public dissemination of knowingly false information about the use of the Armed Forces of the Russian Federation, the exercise by state bodies of the Russian Federation of their powers, the provision of assistance by volunteer formations, organizations or individuals in the performance of tasks assigned to the Armed Forces Russian Federation or troops of the National Guard of the Russian Federation) and 280.4 of the Criminal Code of the Russian Federation (public calls for activities directed against the security of the state).

Part 2 of Article 280.4 of the Criminal Code of the Russian Federation is proposed to be supplemented with clauses on the commission of a crime for mercenary reasons or for hire and for reasons of political, ideological, racial, national or religious hatred or enmity, or for reasons of hatred or enmity against any social group. However, it is not proposed to change the prescribed punishment. The bill also expands in this article the list of articles of the Criminal Code of the Russian Federation, which are indicated in the note as crimes directed against the security of the Russian Federation. These include Article 281.1 of the Criminal Code of the Russian Federation (promotion of sabotage activities), 281.2 of the Criminal Code of the Russian Federation (training for the purpose of carrying out sabotage activities) and Article 281.3 of the Criminal Code of the Russian Federation (organization of a sabotage community and participation in it).

The bill will allow confiscate money, valuables or other property“used or intended to finance criminal activities against the security of the Russian Federation, as well as by court decision to deprive of honorary titles” for a number of crimes:

dissemination of deliberately false information about the use of the RF Armed Forces (Article 207.3 of the Criminal Code);
public calls for extremist activities (Article 280 of the Criminal Code);
public calls for actions aimed at violating the integrity of the Russian Federation (Article 280.1 of the Criminal Code);
public actions aimed at discrediting the use of the RF Armed Forces (Article 280.3 of the Criminal Code);
public calls for activities directed against the security of the state (Article 280.4 of the Criminal Code);
calls for the introduction of sanctions against the Russian Federation and its citizens (Article 284.2 of the Criminal Code);
providing assistance in the execution of decisions of international organizations in which the Russian Federation does not participate, or foreign government bodies (Article 284.3 of the Criminal Code);
rehabilitation of Nazism (Article 354.1 of the Criminal Code), etc.

Amendments to the legislation have been previously worked out and conceptually supported by the Prosecutor General’s Office, the Investigative Committee, the Ministry of Justice and Rosfinmonitoring.

The implementation of the federal law is primarily aimed at preventing and suppressing criminal activities carried out in order to undermine the foundations of the constitutional order, the country’s defense capability and state securitysays the explanatory note.
