Forecast: dacha amnesty for houses and public buildings may be extended

The effect of the dacha amnesty, reports Russian newspaper, can be extended until 2031 not only for summer houses and residential buildings, but also for buildings and structures that belong to the common property of gardening and vegetable farming partnerships. A group of State Duma deputies from United Russia and members of the Federation Council proposed making the necessary amendments to Article 70 of the Federal Law “On State Registration of Real Estate.”
Among the buildings that, due to an oversight of summer residents, may end up in the “gray zone” are a transformer box, a watchman’s house, a board room or a water tower. All these structures must comply with the requirements of the Town Planning Code of the Russian Federation and can only be used on the basis of permits for construction and for putting the facility into operation. In the current version of the law on state registration of real estate, the dacha amnesty for the common property of gardeners and gardeners ends on January 1, 2024. We are talking about buildings that were erected before 2004. To register them in the cadastral register and carry out state registration of rights in a simplified manner, all you need is a declaration drawn up by the chairman of the partnership, even without preparing a technical plan. The document must be submitted to the MFC or posted on the State Services portal. But one of the main reasons for the delays is the lack of registered rights to the land plots on which certain public facilities are located.
If this procedure is canceled, then it will be possible to register these buildings only through the court, since they often do not have the necessary permits, as required by urban planning legislation“, notes one of the authors of the bill, First Deputy Speaker of the Federation Council Andrei Turchak, in his Telegram channel.
The dacha amnesty mechanism, which allows citizens to register rights to country real estate in a simplified manner, has been in effect in Russia since 2006 and has been extended several times. In the Moscow region alone, in 2022, 93 thousand real estate objects with a total area of 10 million square meters were registered.
On July 1, Russian President Vladimir Putin extended the period for the dacha amnesty until March 1, 2031. It concerns residential and garden houses on land intended not only for gardening, but also for individual housing construction and personal farming within the boundaries of a populated area. Garden houses, garages, bathhouses, and outbuildings are also subject to registration. Unregistered houses and buildings may be recognized as unauthorized constructions, which threatens their demolition. This property cannot be used as a full-fledged asset, that is, inherited, rented out or sold. We also remind you that from October 1 of this year, issues such as the fate of the common property of SNT, the installation of barriers and other restrictions cannot be resolved without a general meeting of owners. If earlier there were cases when the owner of the site bought the road and blocked the entrance for other gardeners, now such actions are illegal.
