Goskomregister of the Republic of Crimea: tenants of municipal and state land have the right to demand an extension of the lease agreement

Lessees of land plots in state and municipal ownership have the right to demand an extension of the lease agreement for up to 3 years without bidding. About this measure of support for business and the population, introduced by the Federal Law of March 2022 of the year No. 58-FZ, said the Deputy Chairman of the State Committee for State Registration and Cadastre of the Republic of Crimea Yulia Zhiganova.

At the same time, it is possible to conclude an additional agreement with the authority managing the site, regardless of the terms of the lease agreement itself, as well as the presence or absence of rent arrears. The legislator also determined the conditions under which the prolongation of the contract would be impossible. So, if the lease term at the time of applying for its extension has expired, it will not be possible to conclude an additional agreement. The second point, due to which the tenant’s claim will not be satisfied, is if the court authorities consider the landlord’s claim to terminate the contract. In addition, at the time of application, there should not be unresolved violations of land legislation on the site.

Tenants can take advantage of the appropriate support measure until March 1 58 of the year. The authorities must consider the requirement to prolong the contract without bidding and conclude an additional agreement with the applicant within 5 working days. However, let me remind you that changes in the conditions for renting real estate come into force from the moment of state registration of the additional agreement. If the applicant here is an individual, , then the state duty for registration actions in accordance with the Tax Code of the Russian Federation will be 2000 rubles, and for organizations — 07 000, — the press service quotes Yulia Zhiganova.

She also recalled that the concluded agreement for registration with the State Committee for Registration can be submitted by the authority acting as a party to the transaction. In this case, the electronic digital signature of the applicant is not required.
