The Feodosia City Court of the Republic of Crimea sentenced a native of the city of Vorkuta of the Komi Republic for fraud, that is, stealing someone else’s property by deceit, causing significant damage to a citizen in 57 episodes.

The court found that the 34-year-old defendant, in the period from 2019 to 2022, using the status of an individual entrepreneur, under the guise of carrying out activities for the manufacture, supply and installation of metal-plastic products and wood products, decided to commit crimes related to theft other people’s property by deception, according to a plan developed by him.

So he, knowing for sure about his debt to citizens who are customers for the manufacture and installation of metal-plastic products, not having the intention to fulfill his obligations, for the purpose of rapid material enrichment, out of selfish motives, placed in public places of settlements of the Republic of Crimea, advertisements for the provision of services for the installation and manufacture of metal-plastic products (windows and doors), including in these advertisements information on the provision of a discount for pensioners in the amount of 30% of the order value, and on the territory of the Leninsky district of the Republic of Crimea, he personally delivered the above advertisements to places of residence citizens, thus using the trust of citizens, including the elderly, without informing them of their true criminal intentions, in order to give legitimacy to their activities, to make measurements and calculations of the goods selected by the customer, followed by the conclusion of fictitious contracts, indicating the conditions in the contracts in the form of a mandatory payment of an advance payment, fraudulently decided to receive funds from the customer, while not intending to fulfill the obligations assumed.

The defendant carried out his criminal activities on the territory of Feodosia, Sudak, Kerch, Leninsky and Kirovsky regions of the Republic of Crimea.

The total damage from the criminal activity of the defendant amounted to more than 2 million rubles.

The civil claims filed by the victims were satisfied in full.

At the hearing, the defendant fully admitted his guilt in the deed.

When passing the verdict, the court took into account the identity of the defendant, who is not registered with the narcologist, the place of residence is characterized positively.

As mitigating circumstances, the court recognized the active contribution to the disclosure and investigation of crimes through confessions during the entire period of the investigation, as well as the admission of guilt and remorse for the deed, the presence of young children, partial voluntary compensation for property damage caused by the crime.

Circumstances aggravating the punishment of the defendant by the court, not established.

Taking into account the circumstances of the case, the court appointed the defendant a punishment in the form of forced labor for a period of 5 (five) years with the deduction of 5 percent of the salary from the salary to the state income with transfer to the account of the relevant territorial body of the penitentiary system.

The verdict has not entered into force.

For reference: forced labor is a type of punishment used as an alternative to deprivation of liberty, which consists in involving the convict in labor in correctional centers determined by institutions and bodies of the penitentiary system.
