In Sevastopol, a boarding school will pay a million rubles in damages in court. What happened?

In Sevastopol, taking into account the position of the prosecutor’s office, compensation totaling almost 1 million rubles was recovered in favor of the mother of a disabled child who was injured in a boarding school.

It was established that a boy born in 2007, who was a 6th grade student at the state budgetary specialized (correctional) educational institution in Sevastopol “Comprehensive boarding school No. 1,” has developmental disorders, as a result of which he needed constant monitoring. However, in April 2021, he received a compression fracture of 7 vertebrae while in the toilet of the institution without the supervision of boarding school workers. As a result of the injury, the child was forced to remain in bed for several months and underwent long-term treatment and rehabilitation.reports the press service of the Sevastopol prosecutor’s office.

The victim’s mother filed a claim with the Leninsky District Court of Sevastopol for compensation for the damage caused.

The prosecutor participating in the consideration of the case gave an opinion on the validity of the woman’s claims, since according to the current legislation, the Charter of the boarding school and the contract for the provision of services, the educational institution is responsible for preserving the health and life of students during the educational processnoted the prosecutor’s office.

The court, taking into account the opinion of the prosecutor, granted the claim and recovered from the boarding school in favor of the mother moral damages, material damage and legal fees totaling almost 1 million rubles.

The defendant appealed the court decision, but the Sevastopol City Court agreed with the arguments of the plaintiff and the prosecutor and rejected the appeal. The court decision has now entered into legal force.
