In Yalta, a local resident was convicted of illegal fishing of Black Sea mussels

In Yalta, the prosecutor’s office supported the state prosecution in a criminal case against a 63-year-old local resident. He was found guilty under Part 3 of Art. 256 of the Criminal Code of the Russian Federation (illegal extraction of aquatic biological resources), Part 5 of Art. 327 of the Criminal Code of the Russian Federation (use of a knowingly forged document).

The court found that the convict, being the head of the enterprise, knowing that the issued operating regime for the mussel and oyster farm had expired, did not suspend the operation of the enterprise, and gave illegal instructions to subordinate employees to catch Black Sea mussels.

In total, the enterprise illegally extracted about 500 thousand specimens of aquatic biological resources worth more than 6.3 million rublesreports the Prosecutor’s Office of the Republic of Crimea.

But this is not the end of the story. To avoid criminal liability, the man provided law enforcement agencies with forged documents on the purchase of Black Sea mussels. The illegal actions of the convict were stopped by officers of the Border Department of the FSB of Russia for the Republic of Crimea.

The court, taking into account the opinion of the state prosecutor, sentenced the man to 2 years of suspended imprisonment with a probationary period of 1 year. The boat used to catch biological resources was confiscated to the state. The prosecutor’s claim to recover damages from the convicted person in the amount of more than 6.3 million rubles was satisfied in full. The verdict did not enter into legal force.
