Ministry of Labor: the list of grounds for an unscheduled inspection has been expanded

The Commissioner for the Protection of the Rights of Entrepreneurs in the Republic of Crimea, Svetlana Luzhetskaya, informs entrepreneurs that the Ministry of Labor and Social Protection of the Russian Federation has expanded the list of risk indicators when exercising federal state control (supervision) over compliance with labor legislation and other regulatory legal acts containing labor law norms.

On January 8, the provisions of Order No. 836n of the Ministry of Labor and Social Protection of the Russian Federation of November 28, 2023 came into force, the provisions of which added the following grounds to the list of indicators of the risk of violation of mandatory requirements that are taken into account when deciding to conduct and select the type of unscheduled control event:

  • the average value of an employee’s remuneration is below the minimum wage, with the ratio of the size of the wage fund and the number of employees per employer per quarter (except in cases of granting leave without pay, suspension from work without pay, establishing a reduced working day (shift), layoff tariff rate, salary (official salary);
  • no personnel changes at one employer for the quarter, subject to a reduction in mandatory contributions to the Social Fund of Russia by 50%.
