Official: senators clarified the conditions for payment of maternity capital

Maternity capital will be paid only to persons who have Russian citizenship at the time of the child’s birth, and only if the child is a Russian citizen by birth. The Federation Council approved such a law at a plenary meeting on December 22.
Amendments to the legislation are necessary in order to eliminate a loophole in the current law, due to which families with children who received another citizenship at birth can apply for maternity capital after receiving Russian passports,” explained one of the initiators of the amendments, Senator Elena Afanasyeva, in her Telegram channel.
For now, Russian citizens can receive maternity capital, regardless of the date they acquired citizenship, upon the birth of a child with Russian citizenship. The law adds two conditions to this: the child must have citizenship by birth; Parents must already have Russian citizenship at the time of the child’s birth.
A child acquires citizenship by birth if:
- both parents or the only parent at the time of the child’s birth have Russian citizenship;
- one of the parents is a citizen of Russia, and the second is a stateless person;
- one of the parents has Russian citizenship, and the other has citizenship of another state, provided that the child was born in Russia or was born abroad, but did not acquire another citizenship by birth;
- both parents (or a single parent) are foreigners or stateless persons, permanently residing in Russia, the child was born in Russia and did not acquire another citizenship by birth.
Afanasyeva drew attention to the fact that the new requirements will not apply to Russian citizens — residents of four new regions, if at the time of the birth or adoption of a child they did not yet have a Russian passport and were permanently residing in the territory of the DPR, LPR, Kherson or Zaporozhye regions.
