“Schemes” for cashing out maternity capital are illegal! The bitter experience of a resident of Feodosia

In Feodosia, a local resident was convicted of fraud with maternity capital. The Crimean woman was found guilty under Part 3 of Art. 159.2 of the Criminal Code of the Russian Federation (fraud in receiving payments).

The court established that the convict, being a mother of three children, wishing to cash out funds from her maternity capital, in May 2020, applied to a consumer credit cooperative operating in the city of Feodosia.

The woman issued a power of attorney to an official of the cooperative, on the basis of which a plot of land was purchased in her name in one of the settlements of the Volgograd region. Next, she entered into a fictitious consumer loan agreement with the cooperative in the amount of 466 thousand rubles for the construction of a residential building on the purchased land plot. In order to cash out funds from maternity capital, the convict submitted to the territorial administration of the pension fund of the Russian Federation the specified fictitious agreement with a statement of desire to use it to pay off the debt to the cooperative,” the prosecutor’s office provided details.

In this way, the defendant received more than 466 thousand rubles, part of which she transferred to an official of the cooperative, and disposed of the rest at her own discretion. A criminal case against an official of the cooperative has been separated into separate proceedings, and the investigation continues.

The woman’s illegal actions were identified and suppressed by internal affairs officers.

The court, taking into account the position of the state prosecutor, sentenced the woman to 1 year and 3 months of imprisonment, which was suspended with a probationary period for a similar period. The prosecutor’s claim to recover damages caused by the crime from the defendant was satisfied.
