The administration of Simferopol warns: violations of land legislation lead to fines

The Department of Municipal Control of the Simferopol city administration on an ongoing basis takes measures for municipal land control, during which violations of the mandatory requirements established by the legal acts of the municipality of the city district of Simferopol of the Republic of Crimea are revealed. The main violations of land legislation identified in the course of land control measures are:

1. Use of land plots not in accordance with the intended purpose.

2. Unauthorized occupation of land plots of municipal property.

3. Violation of the requirements of town planning regulations in the course of construction of real estate objects.

Administrative liability is provided for these violations.

Thus, according to Article 8.8 of the Code of Administrative Offenses of the Russian Federation, for the use of land plots not for their intended purpose in accordance with their belonging to a particular category of land and (or) permitted use, a fine is provided:

  • for citizens: in the amount of 0.5 to 1% of the cadastral value of the land plot, but not less than 10 thousand rubles;
  • for officials: from 1 to 1.5% of the cadastral value of the land plot, but not less than 20 thousand rubles ;
  • for legal entities: from 1.5 to 2% of the cadastral value of the land plot, but not less than 100 thousand rubles.

If the cadastral value of the land plot is not determined, the administrative liability in the form of an administrative fine is:

  • for citizens: from 10 thousand to thousand rubles;
  • for officials: from thousand to thousand rubles;
  • for legal entities: from 100 thousand to 200 thousand rubles .

In the cases provided for in Article 7.1. The Code of Administrative Offenses of the Russian Federation (“Unauthorized occupation of a land plot”), including the use of a land plot by a person who does not have the rights to the specified land plot provided for by the legislation of the Russian Federation, provides for administrative liability in the form of a fine:

  • in the amount of 1 to 1.5% of the cadastral value of the land plot, but not less than 5 thousand rubles;
  • for officials: from 1.5 to 2% of the cadastral value of the land plot, but not less than 20 thousand rubles;
  • for legal entities : from 2 to 3% of the cadastral value of the land plot, but not less than 100 thousand rubles.

In the event that the cadastral value of the land plot is not determined:

  • for citizens: in the amount of 5 thousand to 10 thousand rubles;
  • for officials: from 20 thousand up to 52 thousand rubles;
  • for legal entities: from 100 thousand to 200 thousand rubles.

Please note that for the administrative offenses provided for in this article, persons engaged in entrepreneurial activities without forming a legal entity bear administrative responsibility as legal entities.

Another most common violation is the non-compliance by owners and tenants of land plots with the requirements of urban planning regulations provided for by the Temporary Rules for Building and Land Use.

For all these violations, an administrative fine is provided for both individuals and legal entities.
