President of the Notary Chamber of the City of Sevastopol Olga Kalenkovich summed up the results of 2023 and answered questions from listeners of the “Legal Environment” program on radio “KP-Sevastopol”.

About the electronic archive

— What innovations in the work of notaries were there in 2023?

— This year the law on notarial archives of the Russian Federation came into force. The notarial archive is a fundamental innovation in the system for organizing the storage of notarial documents. If previously all archives of documents were kept by the notary himself, now documents older than 10 years will be transferred to the notary archive of the region. In our case, the Notary Archive of the city of Sevastopol.

In addition, this year there were changes in the pricing of notarial acts. Now we have regional and federal tariffs. It is established at the legislative level who decides the tariff, what formula is used to calculate it, and where prices come from. Now all this is enshrined in law.

If we talk about innovations directly related to notarial actions, then almost all of them are related to the electronic version of performing these notarial actions. Thus, from March 2023, it is possible to obtain information about an entry in the USRN about an individual only through a notary. There is now an opportunity to make an appointment with a notary public at State Services. You can sign up for a specific type of action and immediately send a package of documents to reduce waiting time. The notary will prepare everything in advance for your visit.

Machine-readable powers of attorney have been created, this is also a very convenient service. Many actions have been transferred to electronic form, and now a simple electronic signature of the applicant using a tablet is enough to verify them. That is, a person does not need to carry paper documents with him; everything exists in electronic form.

I would also like to note that this year the number of contracts certified remotely by two or more notaries has increased. If last year we had only 39 of them, then as of December 1 of this year there were already 80 of them. This type of notarial act has become very popular. Since, if an agreement is concluded between persons located very far from each other, then remote the format of its conclusion allows not only to significantly save time, but also money.

— What is the main goal of creating an electronic archive?

— Previously, this was not regulated by law. If a notary resigned, his archive was transferred to another current notary. As you understand, every year the archives become larger and larger. Notaries needed to rent larger premises to store and process documents. Now it is legally determined that the notarial archive has the status. It is created at the notary chambers of each subject and will exist there. Moreover, an electronic archive has been created.

Notaries will keep the archive itself in full for 10 years. After this time, the notary will reform the archive and destroy some documents (which do not need to be stored for longer than 10 years). The remaining documents will be converted into electronic form. Naturally, at the initial stage this process will occur gradually and will take a significant amount of time. Archives dating back to 1946 have been stored in Sevastopol. Therefore, there is a lot of work ahead. But everything will be digitized, reformatted and securely stored.

About working in new territories

— Let’s talk about working in new territories. Did Sevastopol specialists participate in training notaries from the liberated territories or help their colleagues in any other way?

— We went to the Kherson region and helped create a notary chamber. Notaries of Zaporozhye and Kherson regionto her came to Simferopol and underwent training there. Those who wished were trained and became directly acquainted with Russian legislation in our offices, so to speak, in practice. Most of the questions were related to electronic services; this is perhaps the most difficult thing to master. Not every person who now permanently resides in the liberated territories can travel to Crimea or the Russian mainland. Therefore, a lot of notarial actions are performed remotely. — Is it now possible to issue, for example, a deed of gift for an apartment located in the liberated territories, or re-register any rights related to real estate in the LPR or DPR while physically being in Sevastopol?

— There are restrictions here not because of new territories. In accordance with our legislation, in the case of notarization of a transaction for the alienation of real estate, it is carried out only at the location of this property. That is, in Sevastopol it is possible to alienate only an apartment, house or land located only on the territory of Sevastopol. That’s why, if the property is located in new regions, you can only complete the transaction there.

It will be possible to complete a transaction remotely if one of the parties is located in a new region. For example, the buyer is in Donetsk, Melitopol or Genichesk, and the seller is in Sevastopol.

About benefits

— What benefits for individuals arriving from liberated territories were provided in 2023?

— Benefits were and are provided, but in a different way. Changed in October 2023 procedure tariffs. Previously, the second part of the tariff was called a legal technical service (LCTS), and since October it has been a regional tariff. UPTH was approved by the Federal Chamber of Notaries, so it had the opportunity to independently determine preferential categories of citizens.

In October, the situation changed, the concepts of federal and regional tariffs appeared. The federal tariff is actually a state duty. Now citizens arriving from new regions are exempt from paying it. And the regional tariff isis established in accordance with By order of the Ministry of Justice, no benefits are provided for this category of applicants.

Therefore, benefits are still provided, but differently. Until October, notaries did not charge UPTH, and from October they did not charge state fees.

— Are discounts still available for SVO participants and members of their families?

— Necessarily! We performed such notarial actions as drawing up a power of attorney, will, consent, in a relationship childrento her, without charging UPTH until October. And now — without paying the regional tariff. In addition, the spouse, children and parents of a deceased serviceman are exempt from fees in case of registration of inheritance rights and other types of notarial acts.

Just please remember to tell the notary that you belong to a preferential category when you come to your appointment. For example, you are a widow or that your father/son died in the NWO zone. Since the notary cannot find out this except from your words. AND Of course, in order for you to be granted a benefit, you will need to provide supporting documents.

About on-site consultations

— Are there any plans for on-site consultations in villages next year?

— Yes! Such events have been planned since the beginning of the year together with the Government of Sevastopol And the Defenders of the Fatherland Foundation. Once a month, notaries travel to remote villages for consultations. Many questions come through the SVO, but there are also a lot of notarial questions. Citizens come to such consultations with various questions. The working group is formed from several specialists — a notary and a representative of some department. And, if a village resident comes to the reception with a question that is not within our competence, then we direct him where exactly he should go.

Therefore, I appeal to the residents of the villages of the city of Sevastopol. Follow the information from your municipalities, they always inform you where and when the meeting will take place.
