The President of the Notary Chamber of the city of Sevastopol took part in recording the next series of stories for the Sevastopol television program “I Have the Right”. The TV show is always popular among Sevastopol residents; with its help, viewers will learn answers to everyday questions regarding the competence of a notary.

The host of the program, Nikolai Skrabets, talked with Olga Kalenkovich about the right of inheritance, transactions and disposal of property.

In upcoming episodes, viewers will learn answers to the following questions:

  1. What to do if one of the heirs retains a document confirming the testator’s right to the land plot? Can a notary issue a certificate of inheritance in this case?
  2. When certifying an agreement on the payment of alimony, does a notary have the right to require a certificate of income of the alimony payer, and also to take into account whether the payer has other children and the fulfillment of his obligations for their maintenance? What is the minimum amount of alimony that can be specified in the agreement?
  3. The horticultural partnership needs information about the owners of land plots from the Unified State Register of Real Estate in order to verify the data when compiling the register of SNT members. In addition, the partnership needs information about the owners of adjacent land plots in order to file claims in court. What circumstances are sufficient when an interested person submits an application to obtain an extract from a notary? What evidence does a notary have the right to require?
  4. At the time of death, the father was entitled to receive an annual bonus, which is calculated by the employer at the end of the calendar year in proportion to the time worked. Is the annual bonus, which was not accrued on the day of the employee’s death, included in the inheritance?
  5. Is it possible to conclude a lifelong maintenance agreement with dependents between mother and daughter? Or should the daughter support her mother in accordance with the law even without an agreement?
  6. My wife and I agreed on an agreement on the division of jointly acquired movable property; we have a car, but we do not have real estate. The notary demanded that the property be assessed by an independent appraiser. Are the notary’s demands legal? Can we determine the cost by contract?
  7. I took out a loan from a bank against a car. The loan was fully repaid and all payments were made on time. When and how can I remove the lien on my car so that I can safely sell it?
  8. After the death of his father, a company remained — a limited liability company, in which the deceased was the only founder. The constituent documents are retained by the second heir. How can I inherit a company?
  9. My dacha neighbor constantly insults me on social networks. Can a notary certify the presence of offensive phrases so that I can use it in court?
  10. I decided to sell my share in real estate. Can I notify a co-owner through a notary? How practical is this?
