The results of the activities of the Russian notary over the past year, current legislative innovations, as well as further plans for the development of the notary institution were discussed at the annual Meeting of representatives of notary chambers of the constituent entities of the Russian Federation, which took place in Moscow on April 26, 2024.

The Commissioner for Human Rights in the Russian Federation, Tatyana Moskalkova, addressed the participants of the event with a welcoming speech. Tatyana Nikolaevna expressed gratitude to the notary community, noting that its representatives are highly professional people who always find solutions to effectively protect human rights and freedoms.

I advocate for notarized legal facts and transactions to be present on a larger scale. Because in case of disputes in court, a notarial document has great legal force and works for the person“, Tatyana Moskalkova noted, also emphasizing the significance of the cooperation agreement between the Commissioner for Human Rights in the Russian Federation and the FNP, which was concluded six years ago.

The great contribution of notaries to strengthening the legal basis of civil transactions was also noted by the Ministry of Justice of the Russian Federation.

The domestic notary is one of the key parts of the legal assistance system in the Russian Federation. By providing qualified notarial advice and helping to carry out legally significant actions, notaries ensure the protection of the legitimate interests of citizens and entrepreneurs, contribute to the development of economic and property relations— says the address of the Minister of Justice of the Russian Federation Konstantin Chuychenko, which was read during the Meeting by the head of the department for notary issues of the Department for the Development and Regulation of Legal Aid and Legal Services of the Ministry of Justice of the Russian Federation Anna Korshunova.

A report on the results of the notary’s work at the end of the year, as well as on the activities of the president and board of the Federal Notary Chamber in 2023, was presented by the head of the FNP, Konstantin Korsik.

One of the key and socially significant areas of work of the Russian notary in 2023, as in the year before, was the support of SVO participants and members of their families, mobilized citizens and internally displaced persons. This is, first of all, the provision of benefits by notaries to these categories of citizens. Konstantin Korsik also noted the active cooperation of notary chambers of the constituent entities of the Russian Federation with branches of the State Fund “Defenders of the Fatherland”, fundraising and humanitarian aid for military personnel, direct participation of notaries in the formation and delivery of goods to the Northern Military District zone, active participation in events held by authorities and local self-government and etc.

I express my gratitude to the notary chambers for their high civic position in such systematic work, cohesion and unity, and the participation of members of the notarial community,” the head of the Russian notary emphasized in his speech.

Also in 2023, in close cooperation with the Ministry of Justice of the Russian Federation, intensive work continued to integrate notaries of new constituent entities of the Russian Federation into the Russian legal system.

Speaking about the key legislative changes in the field of notaries in 2023, Konstantin Korsik noted the resolution of the issue with the organization of notarial archives, the granting of notaries the authority to provide personal information from the Unified State Register of Real Estate and, of course, the entry into force of a new notary tariff system.

We see its balance and effectiveness both in terms of ensuring the accessibility of notarial actions and in terms of ensuring self-financing of the notary office, — noted the head of the FNP.

In terms of the development of the large-scale “electronic notariat” project, which turns 10 years old this summer, important innovations at the end of the year included: the introduction into notarial practice of a unified format of a machine-readable power of attorney based on the joint technology of the Federal Tax Service and the Federal Tax Service, the implementation of a service for obtaining information from the Ministry of Internal Affairs on applicants’ passports, expanding the list of remote notarial actions, integrating the notary UIS with the Rosreestr system in new constituent entities of the Russian Federation, as well as assigning the notary UIS the status of the official repository of notarial electronic documents. A significant event was the launch of the notary appointment service through the State Services portal, which has already shown demand among the population.

At the same time, legislation in the field of notaries continues to actively develop. This is evidenced by a number of initiatives that are under consideration and which are aimed at expanding the competence of a notary and increasing the efficiency of his work. Thus, the State Duma is considering a bill establishing a mandatory notarial form for real estate donation agreements between persons who are not close relatives. In relation to the corporate sphere, it is worth noting the bill that allows general meetings of participants of JSCs and LLCs to be held and decisions made there to be notarized entirely in an online format. A number of projects that are currently under consideration by the legislator relate to improving the interaction of the notary with various departments and structures in electronic format: Rosreestr, civil registry offices, credit history bureaus, etc.

A current and socially significant bill is one that allows the heirs of SVO participants to accept an inheritance after the expiration of the period established by law for a good reason, without going to court. Such an initiative will also have a positive effect in terms of relieving the workload of the judiciary. The same task is met, among other things, by the idea of ​​expanding the scope of application of a notary’s writ of execution. Russian President Vladimir Putin also spoke about the problem of court congestion this week during a meeting with the Chairman of the Supreme Court of the Russian Federation Irina Podnosova. It has also been repeatedly noted in expert circles that judges are overwhelmed with so-called indisputable cases that can be transferred, among other things, to a notary.

In addition, the initiative to introduce a mandatory notarial form for decisions on changing the general director of a company has repeatedly received positive assessment from experts. A bill assigning to a notary the authority to verify the grounds for such a decision is ready to be submitted to the State Duma. Another current initiative is to assign mediator functions to notaries, in particular in the field of inheritance matters.

Within the framework of the Meeting, the report of the President and the Board of the Federal Notary Chamber, reports on the implementation of the Social Support Program for the FNP and the Program for Supporting Notaries in Hard-to-Access and Sparsely Populated Areas, etc. were also approved. A number of organizational decisions were also made on the activities of the FNP.

The final part of the event was the awards ceremony. The Yuri Iutin Medal “For Impeccable Service and Fidelity to the Profession” was awarded to the President of the Kostroma Regional Notary Chamber Nikolai Melnikov. Badge «For services to the notary» President of the Notary Chamber of the Novosibirsk Region Nadezhda Afanasyeva and President of the Notary Chamber of the Vologda Region Elvira Sergeeva were born.

Based on the results of a comprehensive audit of the organization of activities, the Notary Chamber of the Perm Territory was awarded a Certificate of Honor from the FNP. The president of the chamber, Olga Mokrushina, was awarded the badge “For services to the notary public,” and its ex-president Nadezhda Pyankova was awarded the Yuri Iutin medal “For impeccable service and loyalty to the profession” for her personal contribution to the development of the notary public in the Perm region.

Based on the results of a comprehensive audit of the organization of activities, the Notary Chamber of the Republic of Sakha (Yakutia) was awarded the FNP Certificate of Honor. The president of the chamber, Tuyana Trofimova, was awarded the badge “For services to the notary public.”

The President of the Notary Chamber of the Republic of Bashkortostan Irina Sukhova and the President of the Notary Chamber of the Komi Republic Galina Malysheva were awarded the medal “For many years of conscientious work in the notary office”, 2nd degree. The President of the Chelyabinsk Regional Notary Chamber Natalya Kuzmina and the President of the Kaluga Regional Notary Chamber Svetlana Zhanzharova were awarded the 3rd degree medal “For many years of conscientious work in the notary office.”
