«Azbuka Rosreestr»: how to remove the destroyed property from the cadastral register?

The Unified State Register of Real Estate (EGRN) contains information on thousands of objects, whether it is a land plot, a house or an apartment. Each property has its own period of operation and there comes a time when the object is no longer subject to restoration or demolished for some other reason. Such objects must be removed from the state cadastral register, as well as the right of ownership to them, if it was previously registered, should be terminated.

Why deregister a property?

There are several reasons to remove a property from the cadastral register:

  • destruction of the property as a result of a fire, earthquake or other natural disaster,
  • in case of demolition or dismantling of property by the owner.

Thus, the ownership of real estate is subject to exclusion from the USRN, since the right to real estate cannot exist in the absence of an object.

The owner is also required to pay taxes on the property he owns. Since the registered right is recognized as existing, the person indicated in the USRN as the owner will be obliged to pay tax, including for a non-existent object.

How to remove a property from the register?

The current legislation provides for the removal of real estate objects from the cadastral register in the event of their destruction or destruction. To do this, you must contact the MFC, with the following documents:

1) an application for deregistration of the property. Such a statement may be submitted by the owner of the building or the owner of the land plot on which the house was located, or his representative on the basis of a notarized power of attorney;
2) title documents for a real estate object subject to removal from the cadastral register (only if the rights to the destroyed object arose before 01/01/1998, and in Crimea and Sevastopol before 03/20/2014 and are not registered in the Unified State Register of Rights to Real Estate and deals with it)
3) identity document of the applicant or representative of the applicant;
4) an act of inspection, confirming the termination of the existence of the property. Such an act of inspection is drawn up by a cadastral engineer based on the results of an inspection of the destroyed object. The form of the survey report and the requirements for its preparation were approved by the order of Rosreestr dated May 24, 2021 No. P / 0217.

As a result of the registration actions, the applicant or his representative will be issued an extract from the USRN on the real estate object, containing information entered into the state real estate cadastre on the termination of the existence of the real estate object.

Removal from the cadastral registration of a real estate object is carried out free of charge within a period of no more than 9 working days from the date of receipt of the application at the MFC.
