Rent an apartment daily, notes Russian newspaper, will be allowed only if it does not create inconvenience to neighbors. The State Duma adopted such a government bill in the first reading.

The bill was developed in pursuance of the ruling of the Constitutional Court. He previously prohibited equating the daily rental of apartments with the hotel business on formal grounds and suggested that legislators regulate the procedure and features of the provision of housing for short-term rental.

According to the document, the owner has the right to provide residential premises for use to a citizen on the basis of:

  • rental agreements (including short-term rentals),
  • free use agreements,
  • lease agreement (for a legal entity).

It is stated that this is possible subject to ensuring compliance with the rights and legitimate interests of neighbors, rules for the use of residential premises, as well as rules for maintaining the common property of the owners of premises in an apartment building.

Deputy Chairman of the State Duma Committee on Economic Policy Sergei Altukhov (ER) told RG that in its current form the proposed amendments do not completely solve the old problem associated with the difficulty of distinguishing between the provision of hotel services and the provision of premises for short-term rental. But the very consolidation of the above responsibilities is, in his opinion, already a big step forward to maintain comfort in apartment buildings and take into account the interests of all residents.

In general, according to him, this area needs to be regulated, especially since daily rental housing is very popular. Indeed, for many travelers this form can be even more convenient than hotel accommodation.

For example, for travelers with children and animals, this is a more economical option, noted the deputy. — For homeowners, renting on a daily basis is also profitable, since the average monthly price of such rentals is several times higher than long-term ones.

An important amendment may be introduced at the second reading.

We will introduce a mandatory rule that at least 75% of the residents of an apartment building must vote and allow this rental on a daily basis, said the first deputy chairman of the State Duma Committee on Construction and Housing and Public Utilities Vladimir Koshelev (LDPR). According to him, such specificity is needed to protect the rights of residents, who often experience discomfort due to the frequent change of neighbors.

Deputies, when further considering this topic, also proposed establishing liability measures for apartment owners who do not respect the rights of their neighbors by renting out housing for daily rent.

Deputy Chairman of the State Duma Committee on Construction and Housing and Communal Services Svetlana Razvorotneva noted that “short-term” residents are not registered in apartments; they often violate public order and sanitary standards. But now, she says, there are no mechanisms to help hold them accountable. By the second reading, she emphasized, serious revision is required; it is necessary to spell out the rights of neighbors and the rules for the use of common property. The minimum delivery period for the premises needs clarification.

In addition, a limit on the number of residents is needed so that “this does not turn into “rubber” apartments,” added Deputy Speaker Irina Yarovaya. And secondly, the owner should be required to collect passport data of residents and report them to the company managing the house.

According to Deputy Minister of Construction and Housing and Communal Services Yuri Mutsenek, the ministry hears these and other proposals and concerns of deputies and supports the need to finalize the draft for the second reading.

Earlier, Nikita Chaplin (ER), a member of the State Duma Committee on Budget and Taxes, told RG in a commentary how not to fall for the tricks of scammers when renting real estate for a day. In particular, he noted that obscenely profitable offers with extremely low prices are a favorite trick of swindlers. In addition, Chaplin advised under no circumstances to transfer the deposit before a personal meeting.
