Bakhchisaray court rendered verdict in the case of an accident in which a motorcyclist died

The Bakhchisarai District Court of the Republic of Crimea sentenced a resident of the city of Yalta to two years’ imprisonment on probation for violating traffic rules, which negligently caused the death of a young man born in 2000.
As established by the materials of the criminal case, at the end of June 2022, at about 12 noon, a man born in 1961, driving a TOYOTA LAND CRUISER, was moving within the village of Uglovoe, Bakhchisaray district. When turning left into the adjacent territory, the off-road driver did not give way to an oncoming vehicle — a REC200-GY8 motorcycle and collided with it during the maneuver. The motorcyclist died from his injuries as a result of the crash.
The conclusion of the forensic autotechnical examination established that both participants in the accident had the technical ability to prevent the accident, but mutual disregard for the rules of the road led to a tragedy.
At the hearing, the defendant agreed with the accusation and admitted his guilt in full.
The court concluded that the defendant was guilty and that his actions were qualified under Part 3 of Art. 264 of the Criminal Code of the Russian Federation — violation by a person driving a car of the rules of the road, which negligently entailed the death of a person.
At the same time, the court took into account the data on the identity of the defendant, his positive characteristics, the presence of mitigating circumstances, the absence of aggravating circumstances, the attitude of the defendant to the deed, the specific circumstances of the case and considered it possible to correct the perpetrator of the accident without actually serving the main sentence and on his conditional conviction.
In addition, the man was deprived by the court of the right to engage in activities related to driving cars and other vehicles of all categories for a period of 3 years.
No civil action has been filed. The verdict has not entered into force.
