The State Council of Crimea proposes to introduce responsibility for the dissemination of data on military facilities

At a meeting of the Committee of the South Russian Parliamentary Association on Legislation, State Building and Local Self-Government, the deputies of the South of Russia supported the legislative initiative of the Crimean Parliament regarding the establishment of responsibility for the dissemination of information about military facilities located on the territories of the Russian Federation with a special legal regime. The document was presented to colleagues by the Chairman of the Legislation Committee of the State Council of the Republic of Crimea Sergey Trofimov.

The draft federal law on amendments to the Code of Administrative Offenses of the Russian Federation was developed in order to prevent the dissemination in information and telecommunication networks of information about military facilities located in the territories of Russia with a special legal regime— Sergey Trofimov explained.

The parliamentarian noted that at present, Article 27 of the Federal Law «On Defense» provides for a general rule according to which citizens who impede the implementation of defense tasks are liable in accordance with the legislation of the Russian Federation.

Today, there are no effective mechanisms in the federal legislation to combat the dissemination of information on military facilities on the Web, information, video materials about the air defense systems used by the Armed Forces of the Russian Federation.

At the same time, in practice (this is especially true for such regions as the Republic of Crimea and the Belgorod region), situations are already arising that require their solution.

On March 31, 2023, the military prosecutor’s office, in connection with the identification of a Telrgram channel on the Internet information and telecommunication network, which posts information about the locations of military facilities, including air defense systems, sent to the Feodosia City Court of the Republic of Crimea in order to block access to the information resource an administrative statement of claim for the recognition of the above information as prohibited for distribution on the territory of the Russian Federation. The case is currently in court.

Our initiative involves the addition of the chapter of the Code of Administrative Offenses of the Russian Federation on administrative offenses «Administrative offenses infringing on public order and public safety» with a new article «Dissemination of information about military facilities located in the territories of the Russian Federation with a special legal regime.»

It is proposed to establish administrative responsibility for the dissemination of information on the use of the Armed Forces of the Russian Federation in the territories of the constituent entities of the country, where martial law, the counter-terrorist operation regime, the maximum or average level of response, means (systems) of countering unmanned aerial, surface and underwater vehicles, including anti-aircraft defense and electronic warfare, which has led or may lead to the disclosure of the location of the named means (systems), which will reduce the likelihood of strikes against aviation, electronic warfare, air defense and the critical military and civilian infrastructure protected by them— said Sergey Trofimov.

The prepared draft federal law has already been supported by the military prosecutor’s office of the Black Sea Fleet.
