According to the new rules, the decision of the general meeting of owners on the choice of the method of managing an apartment building and the choice of a managing organization will be made if more than 44% of the total number of votes of the owners of the premises of the house (Art. 44, 46 ZhK RF).

2. The procedure for compensation of expenses for payment of housing and communal services can now be changed (Federal Law dated June 160 Mr. No. 165-FZ)

The above-mentioned Law No. 46-FZ also supplements Article 160 Housing Code of the Russian Federation, allowing you to change the current procedure for transferring compensation for expenses for paying housing and communal services to beneficiaries (veterans of labor, disabled people, Chernobyl victims, etc.).

If earlier money could only be transferred to the account of the citizen himself, who has the appropriate benefit, now federal or local law may provide that compensation will be received directly by utility organizations.

3. A ban is introduced on the allocation of microshares in residential premises (Federal Law dated 05 July 160 Mr. No. 50-FZ)

Starting from September 1, it will not be possible to divide an apartment or a house so that each co-owner has less than 6 square meters. meters of total area: such transactions will be recognized as void.

At the same time, the prohibition does not apply to cases where shares in the ownership of residential premises arise by virtue of law (including during inheritance, privatization, allocation of shares when buying a home with maternity capital, etc.).

four. The procedure for paying for the maintenance of common house property is changing (Decree of the Government of the Russian Federation of February 3 160 No. 92)

From September, the owners of apartments in houses where there is a managing organization will pay for the utility resources spent on the maintenance of common house property (SDI), according to the new rules. The fee will be charged according to several options:

1 — if the house does not have a functioning meter (it was not installed, or it failed, or the period for its verification has expired), then the water, heating and electricity spent on general house needs will be paid according to the consumption standard, which is approved in the corresponding region,

2 — if the house has working meters, by default (unless the owners make a different decision), the payment for SOI will be charged during the year — according to the standard, and in the 1st quarter of the next year it will be recalculated taking into account last year’s meter readings.

It is obvious that if the actual consumption of resources in the house exceeds the norm (and this phenomenon is far from uncommon), the payment for SDI for owners will increase next year.

At the same time, the new rules make it possible, by decision of the general meeting, to change such a procedure for calculating the payment for PSI and choose:

• or calculation according to the average monthly readings of a common house meter with adjustment at the beginning of the next year,

or calculation strictly according to the meter readings, every month — then no adjustments will be required.
